Acceptance of Terms

By accessing and using EstateIQ's services, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this service. These terms apply to all users of our CRM platform and opportunity services.

Service Description

EstateIQ provides a comprehensive CRM platform and exclusive opportunity access for real estate professionals. Our services include:

• Project-based market intelligence and opportunity management
• Exclusive 3-month opportunity assignments
• CRM functionalities including contact management, task tracking, and analytics
• Email and WhatsApp templates for communication
• Calendar and site visit management tools

User Responsibilities

Users are responsible for:

• Maintaining the confidentiality of their account information and login credentials
• All activities that occur under their account
• Using the service only for lawful purposes and in accordance with these terms
• Providing accurate and up-to-date information
• Respecting the exclusivity of assigned opportunities
• Not sharing opportunity data with unauthorized third parties

Opportunity Exclusivity Terms

All opportunities provided through our platform are subject to the following exclusivity terms:

• Each opportunity is exclusively assigned to one user for a period of 3 months
• Users may not share, redistribute, or transfer opportunities to third parties
• Opportunity data must be kept confidential and used only for the intended sales purpose
• Users must make reasonable efforts to pursue assigned opportunities
• EstateIQ reserves the right to reassign opportunities in case of inactivity or policy violations

Subscription and Payment Terms

Our subscription plans include monthly access to CRM functionalities and opportunity allocations:

• All fees are payable in advance on a monthly basis
• Subscription includes both CRM access and monthly opportunity allocation
• Failure to pay fees when due may result in suspension or termination of services
• No refunds are provided for unused opportunities or partial months
• Pricing is subject to change with 30 days notice

Prohibited Uses

Users may not:

• Use the service for any unlawful purpose or in violation of applicable laws
• Share login credentials or allow unauthorized access to their account
• Attempt to reverse engineer, modify, or create derivative works of our platform
• Use automated tools to scrape or extract data from our platform
• Interfere with or disrupt the service or servers connected to the service
• Violate the exclusivity terms of assigned opportunities

Service Availability

While we strive to provide continuous service availability, we do not guarantee uninterrupted access. We may temporarily suspend service for maintenance, updates, or due to circumstances beyond our control. We will provide reasonable notice for planned maintenance when possible.

Limitation of Liability

EstateIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from your use of the service, even if we have been advised of the possibility of such damages.

Termination

Either party may terminate this agreement at any time. Upon termination, your access to the service will cease, and any outstanding fees will become immediately due. Termination does not relieve you of obligations regarding opportunity confidentiality and exclusivity terms.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through our platform. Continued use of the service after changes constitutes acceptance of the new terms.
